PRODUCTION RIDER
I. BILLING
A. ARTIST to receive 100% star billing in all manner and forms of advertising of this event. Artist shall have exclusive control over the production, presentation and performance.
B. Supporting attractions and length of performance must be approved by ARTIST. All approved attractions must work within the confines of ARTIST'S stage set-up. C. If ARTIST is a support act, PURCHASER shall insure that all personnel working on production of the show and equipment will be available for ARTIST'S load in, sound check, and performance.
II. M.C.'S, SPONSORSHIPS
A. In the event that an M.C. is part of the program, i.e., a sponsoring radio station, or local dignitary, ARTIST, upon approval, welcomes such an introduction. Please notify ARTIST REPRESENTATIVE well before show time. B.Please notify ARTIST or ARTIST REPRESENTATIVE of any sponsorships involved with the performance. Also, ARTIST reserves the right of approval of any signs or banners to be hung at the venue. C. Artist agrees PURCHASER may use ARTIST'S name and pictures in connection with the advertising and publicizing of the engagement hereunder, but shall not be used as an endorsement of any product or service. Such rights shall extend and continue in effect only during the period beginning with the execution of this agreement, and continuing during and throughout the term of this agreement.
III. INTERVIEWS
Please direct all requests for interviews to ARTIST'S REPRESENTATIVES.
IV. BROADCAST, CAMERAS
A.
The PURCHASER agrees that no portion of the performance may be broadcast, recorded, filmed or taped for any purpose without prior consent of the ARTIST or ARTIST'S MANAGEMENT. Still photography will be permitted in front of the stage for a fair and reasonable time to accredited press photographers. Video taping by the audience is to be discouraged, as well as flash bulb use.
B. ARTIST requests that, except in outdoor venues, that there be no smoking in the venue during show times. If this is impossible, then ARTIST requests that the section of the seating closest to the stage be deemed a no smoking section. This is especially important in smaller venues.
V. TICKETS
A. PURCHASER agrees to hold 10 prime tickets for ARTIST'S use. Should ARTIST not use this block of tickets, they will be returned to the box office for sale by ARTIST'S ROAD MANAGER. ARTIST will be happy to return any unused tickets to the box office. B. Should ARTIST'S compensation be based in whole or in part on a percentage of box office receipts, all manner and means of ticketing, manifest, show accounting and settlement shall be at ARTIST'S direction and approval.
VI. PAYMENTS
A. ALL CHECKS OR MONEY ORDERS SHOULD BE MADE OUT TO: Moony Mann B. All guarantees shall be paid to ARTIST'S ROAD MANAGER in cash or certified check prior to ARTIST'S performance. Canadian guarantees shall be paid in U.S. Dollars or with a certified check of U.S. Dollars drawn on a U.S. bank. C. All deposits and other pre-pay securities shall be paid as per instructions from ARTIST'S agency. D. All payments shall be made as provided herein. In the event PURCHASER breaches any provisions of this rider and/or any provisions of the contract to which this rider is attached or fails to make any payments at the time stipulated, ARTIST shall have the right to withhold the performance and any monies deposited in advance will be forfeited by PURCHASER.
VII. HOTELS
A. ARTIST requires Three single hotel rooms. B. All rooms should be in the same hotel. C. All rooms should be non-smoking. D. The hotel should be 'Holiday Inn' type.
VIII. AIR TRAVEL
A. When applicable, ARTIST requires 5 round trip coach air tickets from Fort Myers, FL. B. No tickets should be purchased without prior approval from artists representative.
IX. STAGE
A. A Minimum of 30'x 40' clean, stable and flat deck capable of supporting 125 lbs per square foot, plus a monitor mix position, stage right (16'x8') and 2 sound wings of 8'x 8' at stage left and stage right. These should be available at load in, along with stairs, both stage left and right, and a ramp. Stage must also be within 200 ft of necessary power service for sound and lights. B. Should the performance be outside, a stage covering and mix position covering is mandatory.
X. SOUND AND LIGHTS
Sound and light requirements are to be provided by the PURCHASER at no cost to ARTIST. A. MAINS:
1. A Professional stereo sound system (JBL, EAW or MEYER components or equivalent) with a minimum 3-way active crossover system (two or more crossover points) providing full frequency response. System shall be placed to provide complete audience coverage with a minimum of sight line obstruction. Sound wings, when used, must be separate of the structure. 2. Adequate power to deliver 120 dB of continuous sound with an absolute minimum of total harmonic distortion at the sound console. Sound systems must be able to maintain a sound pressure level of 90 dB at the rear of the performance area. 3. A professional mixing console for the house with adequate length of connecting cable to ensure optimum mixing position in house, we prefer center mix position. Console (Preferred: Yamaha PM3500 also acceptable: Midas Gamble or Soundcraft), minimum of 40 inputs plus 8 subs groups capabilities and 8 programmable mutes. (SEE ATTACHED SHEET FOR MIC LISTING) NOTE: NO PEAVEY OR ALESIS MIXERS PLEASE. 4. Outboard effects:
a) A professional stereo 1/3-octave graphic equalizer (Klarke Technique, ect.) to EQ the mains system. There should be additional EQ for any auxiliary system. b) 6 patchable compressors (DBX, Drawmer, or Klarke Technique) c) 8 channels of patchable gates. d) 2 Digital Reverbs (Yamaha Rev 5, SPX900) e) 1 SDE-330 Digital Delay Unit f) A house stereo cassette deck with playback and record capabilities.
B. MONITORS:
1. A separate, onstage monitor system with components to include: 2. Monitor console-32 inputs and 10 discreet mixes and onstage splitter. (40 inputs if to be shared with another group) 3. 10 matching wedges (Bi-amped) 4. Monitor engineer listen-back wedge and amp channel. 5. 1/3 octave EQ on all mixes 6. Stereo mix for Keyboards 7. 1 SPX 900II 8. Adequate power for monitors and stage gear 9. A minimum of three (3) 20 amp quad boxes for stage power 10. One monitor engineer available from load in to load out. NOTE: NO PEAVEY OR ALESIS MIXERS PLEASE.
C. LIGHTING
1. PURCHASER agrees to provide, at no cost to the ARTIST, a professional, quality lighting system. Any lighting must be cleared with MANAGEMENT company. 2. A Minimum of twelve (12) 1K lekos (ellipsoidal spots) and 32 pars, preferably with quartz-iodide lamps. 3. Ability to make 4 rich color washes: Blue, Red, Lavender, Amber, and the capacity for a 'special' per musician. 4. At least thirty-six (36) dimmers with 3K capacity per dimmer. 5. Instruments should be hung on counter weighted trusses over stage. 6. A light console with 24-channel, 2 scene capability, minimum. 7. One house lighting designer/operator available for set up and run of show 8. Minimum of two (2) followspots (LYACON HALOGEN or Ultra ARC.) Must be equipped with 6-color boomerang, iris, douser and shutters. 9. PURCHASER agrees to provide an experienced operator with each followspot. 10. A Clearcom with at least 5 stations is required. Two (2) followspot stations, one (1) lightboard, one (1) sound board, one (1) stage monitor mixing board. 11. ALSO : Should have on hand adequate color supply, including but not limited to the following (or equivalent)
a) Roscolene: Amber, Red, Pink, Magenta, Lavender, and Blue Green. b). Followspot frames: #1-Pink, #2-Lavender, #3-Amber, #4-Red, #5 Magenta, #6-Blue.
XI. BACK LINE
A. If the engagement is more than 50 miles in radius from Ft Myers, FL, PURCHASER shall provide necessary stage gear at no cost to ARTIST, as advised by MANAGEMENT. (SEE ATTACHED SHEET "BACK-LINE NEEDS') B. Any eventuality wherein equipment provided by or for the ARTIST is to be shared by other bands or acts must be cleared in advance by ARTIST'S MANAGEMENT. C. Not withstanding the above, Moony Mann Band members will always use their own designated equipment and instruments, including drums, placed according to attached stage plot. (SEE STAGE PLOT)
XII. LOAD IN
A. Load in shall be scheduled in order to give adequate time for a complete sound check to take place. B. Ample soft drinks, hot coffee, water and snacks must be available to Moony Mann Band crew at load in. C. At minimum of two (2) stagehands (including house sound technician) should be present to assist Moony Mann Band and crew at both designated stage call and at load out after show. D. Provision for a complete check of the entire sound, light, monitor,and stage systems shall be made, with adequate time to do so before the audience is allowed into the venue. E. Once ARTIST'S equipment has been placed on stage and sound check is completed, it should remain in place and may not be moved without ARTIST'S approval.
XIII. SOUND CHECK
A. Ample soft drinks, hot coffee, water and snacks must be available to the band at sound check.
XIV. DRESSING ROOMS (2)
A. One private, well ventilated dressing room, with private toilet facilities and a mirror for Moony Mann Band's use. B. P.F. would appreciate a pot of coffee and a small fruit and veggie platter, with the accompanying cups, utensils and napkins. C. Please provide a few chairs, if necessary. D. Dressing room should have running water, lights, working electrical outlets, and should be reasonably climate controllable. (not exceeding 76 degrees far.) E. The dressing room should be no more than 100 feet from the stage entrance. F. In the event that trailers or motor homes are used, all of the above (A,B,C, D & E) should hold true.
XV. FOOD
A. 90 minutes before show time, the following should be placed in the the room: B. Plenty of fresh brewed coffee, with milk, sugar. Also, tea bags, hot water and honey. Please have the coffee ready when the band arrives. C. Mirror, Waste baskets D. 12 medium towels (100% cotton) E. 24 bottles of non-carbonated spring water. F. Assorted cold beverages, soda, and 4 six-packs of Miller Lite beer. G. 1 bottle of Merlot would be appreciated. H. Potato chips with dip, whole grain bread I. 1 large deli tray with assorted meats, emphasizing turkey and chicken. J. 1 large veggie tray with dip, as well as some sliced fresh fruit. K. Please provide all the necessary condiments, i.e., bottle opener, ice, cups, napkins, plates, mayonnaise, mustard, eating utensils, and a trash receptacle. L. A hot catered meal, or preferably, a reasonable 'meal buy out' should be made available to the band & crew, to be prearranged with ROAD MANAGER.
XVI. SECURITY
A. PURCHASER agrees to provide adequate security for Moony Mann Band and crew, instruments and vehicles from the moment they arrive at venue until they depart. This includes security in dressing room areas. B. Parking for ARTIST'S transportation shall be provided in close proximity to the dressing room and stage areas.
XVII. CONCESSIONS
A. It is agreed that PURCHASER should allow the ARTIST exclusive right to sell souvenir T-shirts, pictures, EP's, ect., bearing ARTIST'S likeness, and will provide one (1) 6'x 3' table to be placed in a prominent location. If needed, PURCHASER will also make available one person for selling such souvenirs from 1 hour before to 1 hour after show times.
XVIII. INSURANCE
A. PURCHASER agrees to provide public liability insurance coverage to indemnify Moony Mann Band and Moony Mann Productions against injuries to person or property as consequence of the installation and/or operation of the equipment provided by and for ARTIST. B. PURCHASER agrees that Phoenix Falling and Moony Mann Productions will be added names to such insurance policy. In addition, it is agreed that PURCHASER shall maintain in effect, a policy of Workman's Compensation Insurance covering all of it's employees who are involved in the initiating, operation or maintenance of the equipment provided by and for ARTIST. C. Upon Request PURCHASER shall supply ARTIST with a Certificate of Insurance showing coverage of the above at least two (2) weeks prior to the show. However, if this certificate is not received prior to the show, PURCHASER is still responsible for such coverage. $1,000,000 minimum coverage. D. PURCHASER agrees to obtain necessary performance rights licenses (ASCAP/BMI) based on venue capacity and ticket price at no cost to ARTIST.
XIX. CANCELLATION
A. PURCHASER agrees that ARTIST may cancel the engagement hereunder by giving purchaser written notice thereof at least three (3) days prior to the commencement date of the engagement hereunder if the ARTIST shall be called upon to render their services in connection with a legitimate stage play, television show, motion picture, or engagement in the states of Nevada, New Jersey, California and New York.
XX. SICKNESS, ACTS OF GOD
A. ARTIST'S obligation to furnish the entertainment referred to herein is subject to the detention or prevention by sickness, inability to perform, accident, means of transportation, Act of God, fire, riot, strike, or any events of any kind or character whatsoever whether similar or dissimilar to the foregoing events which would prevent or interfere with the presentation of the show. B. Inclement weather shall not be deemed to be a force majuere occurrence, and the PURCHASER shall remain liable for payment of the full contract price even if the the performances(s) called for herein are prevented by such weather conditions. ARTIST shall have sole right to determine, in good faith, whether any such weather.
XXI. PROBLEMS
Any questions, problems, requests or input should be directed to ARTIST'S MANAGEMENT or ROAD MANAGER as noted above. Both parties agree the aforementioned items are important to present the best possible show. To that end, we both resolve to exert best efforts in reasonably resolving any differences that may arise. Moony Mann Band, crew and management are committed to a smooth and successful show and look forward to working with you.
